Contracts and Pay

The New Deal is part of the terms and conditions of service for doctors and dentists in training. By law all employees must have a contract of employment which should be issued within 8 weeks of commencing the post. An employee is considered to have accepted the terms and conditions specified in that contract even if it has not been signed unless objections have been submitted in writing. A contract of employment is a legally enforceable document. Its contents detail the pay and conditions, job description and the obligations of both the employee and the employer (e.g. periods of notice, training facilities, duties of the post).

Since 1st December 2000 Additional Duty Hours (ADHs) have been superseded by Pay banding. The bands reflect whether the post is New Deal non-compliant, whether the doctor works up to 48 or 56 hours per week, the type of working pattern, the intensity of work and the unsocial nature of the post. This is basic Salary plus a percentage.

Any doctor whose rota or shift pattern does not comply with the New Deal will be placed in band 3. This is the most expensive band for Trusts to pay.
